Definitions
“We”, “us”, “our” means NSW Book Publishers (ABN 00 000 000 000), an independent publishing services business based in Sydney, New South Wales.
“You”, “your” means the author or other person placing an order, and anyone placing an order on your behalf.
“Site” means this website and everything published on it.
“Services” means the work described in the written quote you accept — for example editing, cover design, formatting, printing, ghostwriting, illustration, audiobook production, marketing or distribution.
“Order” means a quote you have accepted in writing, together with any deposit or payment made against it.

Our services
We provide publishing services to authors. We are a service provider, not a traditional publisher: we do not acquire rights in your book, and we do not pay advances or royalties.
The scope of each engagement is whatever is written in the quote you accept. Anything not listed in that quote is not included, and additional work is quoted separately before it begins.
Where a service depends on a third party — a printer, retailer, distributor or advertising platform — we manage the relationship on your behalf, but that party sets its own specifications, timeframes and acceptance rules.

Quotes, orders and payment
We quote in writing before any work starts. A quote is valid for 30 days unless it says otherwise, and the price does not change once you accept it, unless you ask for work outside the agreed scope.
Unless your quote says otherwise, a deposit is payable before work begins and the balance is payable at the milestones set out in the quote. Work may pause if an invoice is overdue.
All prices are in Australian dollars and include GST where it applies. You are responsible for any bank or currency conversion fees your payment method charges.

Your manuscript and your rights
You keep the copyright in your manuscript at every stage. Nothing in these terms transfers ownership of your work to us.
Once the work is paid for in full, you own the deliverables we produce for you — the edited manuscript, the cover artwork, the typeset files, the illustrations, the audio master — and you keep every royalty your book earns.
You confirm that the material you send us is yours to send: that you wrote it or hold the rights to it, that it does not infringe anyone else's copyright, and that it is not defamatory or otherwise unlawful. We may decline or stop work on material we reasonably believe breaches this.
We would like to name your book and show its cover in our portfolio and marketing. You can ask us not to at any time, in writing, and we will remove it.

Confidentiality
We treat your manuscript and anything you tell us about it as confidential. We share it only with the specialists working on your book, and only as far as they need it to do the work.
We will sign a non-disclosure agreement on request, at no charge, before you send us anything.

Revisions and approvals
The number of revision rounds included is stated in your quote. Revisions within that allowance are free and are worked through until you sign off on that stage.
A revision means refining work already agreed. Changing direction after a stage is approved — a new cover concept, a restructured manuscript, a re-record after audio is signed off — is new work, and we will quote it before starting.
Where a stage needs your approval before the next one begins, we will tell you. Delays in approval move the schedule, not the price.

Cancellations and refunds
You can cancel at any time in writing. If you cancel before work starts, we refund your deposit in full. If you cancel partway through, we refund the balance of anything you have paid for work not yet done, and you keep everything delivered up to that point.
Work already completed to the agreed brief is not refundable, because the time has been spent. Where third-party costs have already been committed on your behalf — a print run, an ISBN, ad spend — those are not recoverable either.
None of this limits your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded: if a service is not supplied with due care and skill, or does not match what we agreed, you are entitled to a remedy, and for a major failure that includes cancelling and obtaining a refund. If you think something has gone wrong, tell us first — we would rather fix it.

No guarantee of sales or publication outcomes
We guarantee the quality of the work we deliver. We cannot guarantee commercial results, because they depend on the market, the category, the timing and the book itself.
Nothing on this site or in any conversation with us is a promise of a particular number of sales, a bestseller ranking, a review, media coverage, a retailer placement, or acceptance by any third party.
Any figures we mention about past projects are examples, not forecasts of what your book will do.

Your responsibilities
Keep your own backup of every file you send us. We keep working copies during a project, but we are not your archive.
Give us accurate information and reply to queries within a reasonable time. Long gaps can push the schedule and, if a project stays inactive for more than 90 days, we may close it and re-quote the remaining work at current rates.
Check what you approve. Once you sign off on a proof, a cover or an audio master, that is what goes to print or to the retailer.

Third-party services and links
This site links to other websites and we work with third-party platforms. We do not control them and we are not responsible for their content, their terms or their availability.
Retailers and distributors apply their own listing rules and can change or reject a listing at their discretion. We will do what we reasonably can to resolve it, but the decision is not ours.

This website
The text, design, logos and images on this site belong to us or are used with permission. Please do not reproduce them without asking.
We aim to keep the site accurate and available, but we do not promise it will be uninterrupted or error-free, and content may change without notice.

Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
To the extent the law allows, our liability for any claim connected with an order is limited to re-supplying the service or refunding what you paid for it, whichever we choose.
To the extent the law allows, we are not liable for indirect or consequential loss, including lost profits, lost sales or lost opportunity.

Privacy
We collect only what we need to quote and deliver your project, and we handle it in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our privacy policy explains what we collect and why.
We do not sell your details, and we do not pass them to anyone outside the people working on your book without your permission.

Changes to these terms
We may update these terms from time to time. The version published here is the current one, and the date it was last updated is shown at the top of this page.
Changes are not retrospective: the terms that apply to your order are the ones in force on the day you accepted your quote.

Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
